Episode 22 of our Journey Through a Contract series sees Paul Nightingale and Joel Murphie discussing the distinction between assignment and novation of a contract. One of those provisions inevitably hidden at the back of a contract but not one to be ignored.
Paul and Joel explain the importance of considering provisions to address assignment and novation including could a contract be transferred to a competitor? Whether you should have the ability to assign within your group? Can you assign or novate without consent? Are there any restrictions that you would want to impose on who could take an assignment of your contract? They then go on to consider the practicalities of a partial assignment.

Hosted by Hayley Saunders and Alex Friston, we are delighted to be joined by a variety of speakers, each bringing something different to the table in relation to impacts, views and then thoughts towards the Public Inquiry, which is set to commence its first public hearings on 13 June.
In our first episode, Hayley Saunders welcomes Simon Toseland to discuss his experiences during the Covid-19 pandemic and what this meant for his role as Head of Health, Safety and Fire at Birmingham Airport and the travel industry generally. From media sensationalism regarding queues to getting everything back on track, Simon talks us through his thoughts and reflects on lessons learned.

Paul and Ria explain why its so important to consider which Law should govern a Contract and why it shouldn’t be left to chance. They also discuss the fact that Parties are free to choose whichever Governing Law they wish as well as what happens if a provision isn’t included in a Contract. The guys also identify the distinction between Governing Law and Jurisdiction provisions as they should not be seen as the same thing.
